They announce a new match at an employee meeting. They promise someone a contribution because that employee had a great year.

Then they call the TPA to explain what they already announced.

That’s the wrong order.

Your retirement plan operates under a written document. Eligibility, contributions, and other benefits need to follow its provisions. An owner’s enthusiasm doesn’t automatically change those provisions.

I appreciate an employer wanting to offer better benefits. But good intentions don’t eliminate the need to check the details.

Before making an announcement, contact your TPA and, when necessary, your ERISA attorney. Explain what you want to accomplish and ask what changes, deadlines, costs, and administrative steps would be involved.

A seemingly simple promise might affect more employees than you anticipated. It might require a plan amendment, additional contributions, or changes to payroll procedures.

You should know those things before standing in front of your employees.

Recruiting creates another opportunity for confusion. Someone preparing an offer letter might copy retirement benefits from an old template or describe what they think the plan provides.

Have someone verify that language. “Eligible immediately” and “eligible after a year” aren’t interchangeable, especially to the person deciding whether to accept the job.

Once you’ve made a promise, telling employees that you misunderstood the plan is an uncomfortable conversation. It can also leave you paying professionals to untangle a problem that a short phone call might have prevented.

Generosity is admirable. Preparation makes it useful.

Check the plan, confirm the requirements, and coordinate implementation. Then make your announcement.

Your TPA would rather help you deliver a benefit correctly than hear about it after your employees have already started counting on it.

Business owners sometimes make generous promises before asking whether their retirement plan can deliver them.
